In an ideal world, an individual injured during the course of employment will be justly compensated for his or her injuries. In some cases, however, the employer or an insurance company refuses to disperse funds to the employee, and he or she must find another way to recover damages. If the employee is denied any or all benefits, those benefits can only be recovered through New Jersey’s Workers Compensation Courts and by a Workers’ Compensation Judge.
If you are injured at work, several steps must be followed in order to ensure that you are fully and justly compensated for your injuries.
First, notify your employer or supervisor of the details of your injury and the circumstances surrounding the accident. Pursuant to New Jersey’s Workers’ Compensation Laws, an injured employee has up to 120 days to report the injury in order to recover damages. This does not mean you should wait 120 days after the injury occurs to report it- the sooner an injury is reported, the greater your chances of receiving entitled benefits. After reporting the injury, it is very important to seek immediate medical attention for your injuries.
If your employer or the insurance company refuses to cover the costs of medical treatment, wages from time lost, and any other expenses related to the injury, our workers’ compensation lawyers may be able to assist you. We will work to ensure that you receive all benefits entitled to you under NJ Workers’ Compensation Law.
